Okay well I run a gaming community mainly Valve games cs, tf2, l4d2, csgo, gmod.. Anyways, our website was hosted by a friend who resells server space and stuff like that.. And recently his server was terminated/suspended for using it to send a Dos attack, which we were unaware of until he had told us when it was suspended. Anyway, Exigent are saying we must pay a fee of $160 to retrieve our data from this server..

But my friend who is currently studying law read up on their ToS and has supposedly found a "Loop hole" In their ToS

In Terms and Conditions Sections 9e It states:
"Should we provide you with a copy of your data due to your account being terminated or suspended, a $40.00 fee will apply.
This must be paid in full first before receiving the data.

So what do you guys think, are they wrong or are we?

they have a right not to. Although they do HAVE to only charge you $40 not $160 as that is what they have stated.

also check the TOS to see what exactly it is you can get back, they can be bastards like that and only release certain bits of info for $40
 
Yes but they had agreed that the would give the data for the fee of $160, so technically they said they would, but the fee is wrong.

That's what their trying to use against us.

Saying that "We don't ahve to give the data" But in previous ticket they said they'd do for a fee next ticket after that they said the fee is $160.
 
Have you contacted them and mentioned this $40 fee to get your data? And if so, what was their response?
