1) Backup and Data Loss
Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. WaveConnect.info is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on WaveConnect.info servers. Backups will not be provided for accounts that have been suspended or terminated for any reason unless otherwise agreed to in writing by WaveConnect.info.
2) Indemnification
Customer agrees that it shall defend, indemnify, save and hold WaveConnect.info harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against WaveConnect.info, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless WaveConnect.info against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with WaveConnect.info; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from WaveConnect.info's server.
3) Disclaimer
Waveconnect.info shall not be responsible for any damages your business may suffer. WaveConnect.info makes no warranties of any kind, expressed or implied for services we provide. Waveconnect.info disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by WaveConnect.info and its employees.
4) AUP
You shall use WaveConnect.info services only for lawful purposes. Transmission, storage, or presentation of any information, data, or material in violation of the laws of the United States is prohibited. This includes, but is not limited to: copyrighted material, material that is threatening or obscene, or material protected by trade secrets or other statutes. You agree to indemnify and hold harmless WaveConnect.info from any claims resulting from the use of the service which damages you or any other party.
WaveConnect.info reserves the right to terminate Services for any customer or End User activity that exposes it to legal liability or endangers its ability to provide services to other customers. The contents, links, or actions on any Services listed below are a violation of this Agreement. This is not an exhaustive list, but is designed to assist you in evaluating whether WaveConnect.info is the appropriate service provider for you:
