What do you mean by modding gamer pictures?

using horizon , and getting free gamerpictures then using them on your account

Never been banned for this. Been on xbox for a long time. So in my own experiences no you can not.

You can in fact, my friend was banned for two weeks because of it, but he had put the v1 gamer pic on his profile.

Only for gamer pictures which are unrealistic to get.
