there are many factors here

1.Is it legal in itself that he bought an instagram account. Thats illegal
2.Where was he scammed.If on HF or any similar forum?Thats illegal
3.How does he know that the person who scammed him is a banned LF member
4.He can simply file a report with the authority and let them do the work.

If everybody who have been scammed on forums file a complain with the aithorities then goodluck running the forums.That would bring loads of heat and some shit as well.

Making a ToS doesn't make anything illegal.

What if Instagram had a text in their ToS which said "And you agree that you have to give everything you own to us" - would that be legal? Nope.

Instagram can ban the account, and that's it. Nothing more. Maybe sue for breaking copyright law, but not to the buyer. The seller might get sued because he sold Instagram's property or something like that. But I doubt it will happend.
And HF is not illegal, retard.

If hackforums was illegal, it would have been closed. It's a .com domain, and FBI have tried to, but they can't - because it is legal.
