If Microsoft where to find out that you license transfered on a different account to your console they might ban you.. But thats if they find out and im pretty sure they wont.

I don't think so. I know a guy who license transferred a phished account to his account and he's fine, but who knows. Maybe it was luck

I Honestly do think it is because your getting free DLC witch is against the terms and conditions. Personal opinion.

It's for people who are getting a new console and want to transfer the licenses over to download the games on the new console. On topic though, yes, you can be banned, but it wouldn't be for just license transferring itself. That will get you banned for marketplace theft, but you can also be banned if they see you recovering a large amount of accounts that were once on different Xbox's and IP's. That will get you banned for phishing. Of course if you do it in moderation the chances are slim.
