It'd probably make things harder for turboers since they would need a Death by Captcha account, but the thing about turboing is the percentage of gamers who are affected by it is really, really small. Like, less than 1% of their entire audience. It's not worth Microsoft's time or trouble to address the issue. I doubt it's even on their radar.

When you buy a gamertag, you're buying the ACCOUNT; not the name. The person selling does not own the name. at all. in ANY shape, way or form. If you change the gamertag on the account you bought, you still have the account you purchased; so you making the name available makes it public domain. As all unclaimed gamertags are, naturally. 

Before you ask, No, I don't turbo. I don't even do deals, I simply am not naive enough to get upset when I make a foolish mistake like thinking that buying an account for the tag makes the tag mine if I swap.

"Turbo" is a word used by butthurt people who likely spent WAY too much money for an alias online. If you're going to spend 1k for a tag, be sure you don't have to swap. That's how you ensure that you don't lose it.
 
Or maybe because MS doesn't want people to purchase tags morons.
