For extra added force, the 'Private' section should be made non-viewable to those who haven't upgraded yet. In the upgrades section, it lays out that you will be receiving access to a private forum already. Anyone who wants to report as/to Microsoft could see the marketplace and upgrade to go in and do what they please to.
