How to get unavailable (unused) Instagram handles

Why are some handles not claimed, but are still not available to claim? I try to change my name to it, but it's unavailable & no one has it claimed.
Can anyone tell me why it does this & is there anyway to get one like that.
 
The reason for this is because they're banned
 
Because once account associated with it is banned or closed, the username is deleted forever.
