Being refused a refund?

So I decided to buy some software (for once) since I couldn't find a way around it.
Specifically this was BlueSoleil, I was looking to use bluetooth on my desktop and so that software was one that managed to work but it did not get the job done as well as I thought. Their return policy for software states this

Within 30 days from download of software from our website, if the software does not substantially perform in accordance with the specification, you may return the software and get a full refund or get the replacement from us, at your option.

After 30 days but during the warranty period, if the software does not substantially perform in accordance with the specification, we will provide you with the replacement or refund you, at our option.

I specifically stated this


and I am being refused a refund when they have a clear refund policy.

I would but BlueSoleil works in profiles, so on their home page you can "sign in" and see what products you've bought and what not.. so that's under my email, and won't do any good to request a refund from a different email.
 
Say they're breaking there own T&C's and if you have to you'll open a lawsuit.
