Nope! Call xbox support put a UA on the account, and as long as they see ip correlation you get you're gamertag and you're account back! Just make sure you say you had an important gamertag and your set.

No the account was not banned before it was scammed off me, but im that sure if the guy banned it.

Exactly 5 weeks ago I went to callback my main account that got scammed off me, I called xbox support and gave them my console id and everything. Its been 5 weeks and I still haven't heard from them. Any suggestions on what I should do? BTW I had the account on my console for 1 week and a half...
